Petition for judicial review of award of public procurement contract refused as court grants plea of mora, taciturnity and acquiescence.
The petitioner, represented by Axiom’s Roddy Dunlop QC and Peter Sellar, challenged the award by Comhairle nan Eilean Siar (“CNES”) of a services concession contract relating to the renovation of Lews Castle in Stornoway. CNES, represented by Axiom’s Ruth Crawford QC and Ewen Campbell argued for the respondent that the prayer of the petition should be refused due to mora, taciturnity and acquiescence. Lord Tyre granted the respondent’s plea and refused the prayer of the petition.
