First Scottish sitting of electoral court in 50 years clears Alistair Carmichael MPBack to News Listing
The electoral court, consisting of Lady Paton and Lord Matthews, has cleared Alistair Carmichael MP of illegal practices in the run up to the general election in May 2015. Mr Carmichael had admitted lying to Channel 4 regarding his knowledge of a leaked memorandum, but contended that this did not breach s.106 of the Representation of the People Act 1983 as the lie did not relate to his “personal character or conduct”. The electoral court has agreed, and refused the Petition which sought to unseat him.
Axiom was involved in both sides of the argument, with Lesley Irvine acting a junior counsel for the Petitioners, and Roddy Dunlop QC as senior counsel for Mr Carmichael.
