Prescription - when will it all end?

The law on prescription is going through a transition. Kirsty will consider the recent developments in case law together with the Scottish Law Commission's recommendations in its draft Prescription (Scotland) Bill.

Loss: Key themes from construction cases

Most construction cases involve some attempt to recover in respect of what is said to be a loss and some attempt to avoid liability for that. However, it is not necessarily always well understood when a liability for a loss exists. Jonathan will briefly explore some key themes, including touching upon some recent case law.

Gavin Walker, QC

Concurrent expert testimony.

Gavin will discuss the recent use by the Court of Session of concurrent testimony, also known as “hot tubbing”, for the taking of expert evidence. There have only been two cases where this approach has been used in Scotland. Gavin will explain the various approaches that have been taken to it, what the procedure involves and when it might work best. In particular he will discuss its use in George Leslie -v– Halcrow and why he considers that hot tubbing will be used more frequently by the courts in future.
