Petition of SNP for Judicial Review
28 April 2010
An interim interdict seeking to block BBC transmission in Scotland of third Prime Ministerial election debate unless a representative of the SNP was allowed to participate in the debate on equal terms was refused on the grounds that there was no likely prospect of showing a lack of impartiality on the part of the BBC in excluding the SNP from the debate and, in any event, to grant interim interdict would not be a wise exercise of judicial discretion given the delay in the application for Judicial Review and the lack of precision in the order sought.
Gerry Moynihan QC of Axiom Advocates successfully represented the BBC.
