Legal Services Centre Ltd.-v-Miller Samuel LLP [2009] CSOH 141. Miller Samuel LLP successfully resists multi-million pound damages claim
29 October 2009
In this case, the pursuers sued Miller Samuel LLP for several million pounds following allegations that they had failed to follow instructions in the drafting of a rent review clause for the Procurator Fiscal's building in Glasgow. Following a lengthy proof, Lord Glennie has ruled that the actions of Miller Samuel were in accordance with their instructions, and that even if the pursuers had shown that their instructions were not followed, they had failed to establish any loss as having been caused thereby. Miller Samuel were thus assoilzied. They were represented by James McNeill QC and Roddy Dunlop, both of Axiom Advocates.
