References to the European Court of Justice

Two legal journals, the JLSS and the SLT, have recently published articles by Anna Poole of Axiom Advocates about references by the Scottish courts to the European Court of Justice for a preliminary ruling.
The articles look at recent caselaw on the the legal test applied by the Scottish courts before a reference is made, and at new procedural rules available in the European Court of Justice to fast track cases. The articles are based on a talk given by Anna at the Axiom Advocates Third Thursday series in November 2008.
