The mediation process raises a number of questions.  Do I have to mediate my dispute?  Is there a sanction if I refuse to mediate?  Can I recover the costs of mediation?  What does 'confidential' mediation really mean?  Can I get out of a mediation settlement agreement?  In an article in the Scots Law Times, Anna Poole of Axiom Advocates looks at the response of the courts to these and other questions arising out of mediation.  The article is based on a paper given at an Axiom Advocates Third Thursday lecture on 23 March 2008.
