Gerry Moynihan was Standing Junior Counsel for the Scottish Office in relation to planning matters from 1990 to 1995. He was appointed QC in 1997 and was an Advocate Depute from 1995 to 1998.

Recent cases in the House of Lords and Privy Council include Somerville v Scottish Ministers, Spiers v Ruddy, B v Murray and Helow v Advocate General.

Gerry undertakes a wide range of civil litigation spanning from commercial disputes to professional negligence.

He has an extensive practice in Human Rights and Administrative Law. He is instructed on behalf of public bodies including the Scottish Criminal Cases Review Commission, for whom he acted in recovering records from the Lord Advocate in relation to the case of Campbell and Steel, and in resisting the first challenge by judicial review to a decision not to refer a conviction to the High Court of Justiciary. 

He served as Counsel to the Inquiry into the prosecutions following the death of Surjit Singh Chhoker. He is currently Counsel to the Fingerprint Inquiry, an inquiry set by the Scottish Government under the Inquiries Act 2005.
